1. Data Licensing & Delays

Stock and equity data provided through the Banana Farmer API is end-of-day pricing that reflects the prior trading day's close. Cryptocurrency data may be real-time or near real-time depending on the source.

By using the API, you acknowledge that all data is provided on a delayed basis and should not be used for time-sensitive trading decisions without accounting for this delay.

2. Not Financial Advice

Banana Farmer provides informational signals, scores, and analysis. Nothing provided through the Service constitutes financial advice, investment recommendations, or an offer to buy or sell securities.

You are solely responsible for your own investment decisions. All investing involves risk, including the potential loss of principal. Past performance does not guarantee future results.

3. Rate Limits & Abuse

API access is subject to rate limits as documented in the API documentation. Excessive or abusive use of the API may result in temporary throttling or permanent revocation of your API key without notice.

Prohibited activities include but are not limited to: Attempting to circumvent rate limits, automated scraping beyond documented endpoints, reverse engineering our algorithms, or using the API to create a competing service.

4. Data Redistribution Prohibited

You may not redistribute, resell, or sublicense raw market data obtained through the Banana Farmer API. This restriction is required by our upstream data provider agreements (Tiingo).

You may display Banana Farmer signals, scores, and analysis in your own applications, provided you include proper attribution (see below).

5. Attribution Required

When displaying Banana Farmer data publicly (websites, social media, reports), you must include attribution such as "Data provided by Banana Farmer" or "Powered by Banana Farmer" with a link to bananafarmer.app where reasonably possible.

6. Access Revocation

We reserve the right to revoke API access at any time, for any reason, including violation of these Terms, abuse of the Service, or business reasons. API keys may be revoked immediately without prior notice in cases of severe abuse.

1. Service Provided As-Is

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.

2. Subscription Terms

Banana Farmer Pro is offered as a monthly subscription for $49 per month, or $149 per month for Max tier. Subscriptions automatically renew each month unless cancelled. Payment is processed through Stripe, our third-party payment processor.

By subscribing, you authorize us to charge your payment method on a recurring monthly basis. Prices are subject to change with 30 days' notice to existing subscribers.

3. Cancellation Policy

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. You will retain access to Pro features through the end of the paid period.

We do not offer refunds for partial months or unused portions of your subscription.

4. Data Accuracy Disclaimer

While we make best efforts to provide accurate and timely data, we cannot guarantee the accuracy, completeness, or timeliness of any information provided through the Service.

Market data, scores, signals, and AI-generated content may contain errors or inaccuracies. Always verify information independently before making investment decisions.

5. User Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You are responsible for all activities that occur under your account.

Notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

6. Limitation of Liability

To the maximum extent permitted by law, Banana Farmer and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

In no event shall our total liability exceed the amount you paid us in the twelve months prior to the event giving rise to the liability, or $100, whichever is greater.

7. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

1. Information We Collect

We collect your email address when you create an account for authentication and account management purposes. We also collect API usage data including request timestamps, endpoints accessed, and response times for rate limiting and service improvement.

2. Payment Information

Payment processing is handled by Stripe, Inc. We do not store your credit card information on our servers. Stripe's privacy policy applies to all payment information you provide.

3. Data Usage & Sharing

We use collected data solely to provide and improve the Service, enforce rate limits, and communicate with you about your account.

We do not sell your personal information to third parties. We may share anonymized, aggregated usage statistics that cannot be used to identify individual users.

4. Data Retention

We retain your account information for as long as your account is active. If you delete your account, we will delete your personal information within 90 days, except where retention is required by law or legitimate business purposes (e.g., fraud prevention).

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

2. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.
