• Data is delayed/limited. Equities may be delayed ~15 minutes or fall back to end-of-day. Crypto refreshes periodically. Accuracy not guaranteed.

• Scoring ≠ prediction. “Ripening / Ripe / Overripe” and 0–100 scores are heuristics that can be wrong, late, or incomplete.

1) <u>Educational-Only; No Advice</u>

The Service provides impersonal, algorithmic analytics regarding US-listed equities and top-100 market-cap crypto assets (e.g., composite scores, “Ripening / Ripe / Overripe” badges, brief reasons).
It does not:

• Provide investment, legal, tax, or accounting advice.

• Recommend any specific security, crypto asset, trade, strategy, or timing for any individual.

• Perform brokerage, order routing, or trade execution.

• Create any fiduciary relationship.

You must do your own research and consult a qualified professional before making financial decisions.

2) <u>Registration & Regulatory Status</u>

Banana Farmer is not a registered investment adviser, broker-dealer, commodity trading advisor (CTA), or money services business. We do not provide investment management or discretionary services.
Nothing in the Service should be construed as a solicitation or offer to buy or sell any security or crypto asset.

3) <u>US-Only Availability</u>

The Service is intended solely for persons located in the United States. We use controls (e.g., IP geofencing, payment checks, terms representations) to enforce this.
You must not access or export the Service from outside the US or from embargoed/sanctioned jurisdictions. Attempting to bypass controls (e.g., VPN/proxy) is a material breach of our Terms.

4) <u>Market & Crypto Risks</u>

Trading equities and crypto assets involves substantial risk, including the risk of loss of principal. Risks include, without limitation:

• Volatility & gap risk (prices can move rapidly or open at large gaps).

• Liquidity risk (wider spreads, slippage, inability to exit).

• Market halts/outages and exchange/API downtime.

• Manipulation/pump-and-dump and social-signal distortion.

• Corporate actions (splits, mergers) or protocol events (forks, upgrades).

• Stablecoin de-pegs, custody/counterparty risk, smart contract failures.

• Regulatory changes affecting availability, taxation, or legality.

Past performance is not indicative of future results. You alone are responsible for your decisions and outcomes.

5) <u>Data Sources, Delays, and Accuracy</u>

• Equities: quotes/metrics may be delayed ~15 minutes and can fall back to end-of-day snapshots for parts of the universe.

• Crypto: data updates periodically (e.g., hourly) with more frequent refresh on subsets (e.g., 15-minute for top-trending).

• Social/public signals: we may ingest public velocity/trend proxies (e.g., Reddit/WSB, X aggregates). Such signals can be manipulated, incomplete, or misleading.

• Vendors: Market/crypto data and certain metrics are provided by third-party vendors (e.g., Polygon, CoinGecko) and infrastructure partners (e.g., Cloudflare). Vendor attribution may be displayed in-product.

We and our vendors may experience delays, interruptions, inaccuracies, or format changes. The Service may use caching or sampling, causing displays to differ from broker/exchange feeds. We do not warrant timeliness, sequence, completeness, or correctness of any data or output.

6) <u>Scoring & “Ripeness” Heuristics — Limitations</u>

Our composite scores and badges are heuristics derived from inputs such as price/volume momentum, technical trends (e.g., RSI/EMA/ATR), social-velocity, and for crypto, crowding metrics.
Limitations include:

• Inputs may be noisy, lagging, or contradictory.

• Thresholds/weights (including “Too-Late” penalties) may change without notice.

• We may run A/B tests or variants that alter results per user/session.

• Backtests/hypotheticals (if shown) are subject to survivorship bias, look-ahead bias, and other distortions.
  Interpretation is your responsibility. A “Ripe” badge is not a buy signal; “Overripe/Too-Late” is not a sell or short signal.

7) <u>Examples, Hypotheticals & Testimonials</u>

Any examples, case studies, backtests, charts, screenshots, or user quotes are illustrative and not representative of typical results.
No guarantee is made of profitability, accuracy, or error-free operation.

8) <u>No Personalized Suitability or Monitoring</u>

We do not know your personal financial situation, risk tolerance, investment objectives, or constraints.
The Service does not perform suitability analysis or ongoing monitoring for you. You must independently verify whether any asset or strategy is appropriate for your circumstances.

9) <u>Third-Party Services & Links</u>

The Service may reference or integrate third-party tools (e.g., Stripe for payments, Prefinery for waitlist/referrals, Framer for site build, market-data vendors, email providers).
We do not control or guarantee third-party content, uptime, pricing, policies, or security. Inclusion of a third party is not an endorsement. Your use of third-party services is governed by their terms and privacy policies.

10) <u>Intellectual Property & Redistribution</u>

The Service and its content—including scores, badges, datasets, and UI elements—are protected by intellectual property laws.
You are not permitted to scrape, bulk download, cache, reproduce, redistribute, re-license, or resell Service content or vendor data without our written permission (and, where applicable, the vendor’s).

11) <u>Tax, Legal, and Accounting</u>

Nothing in the Service constitutes tax, legal, or accounting advice. Tax consequences and reporting obligations for securities and crypto vary by person and jurisdiction. Consult qualified professionals.

12) <u>Children</u>

The Service is intended for adults (18+). We do not knowingly provide the Service to, or collect information from, persons under 13.

From time to time we may reference future plans (e.g., roadmap items, features, data coverage). Such statements are aspirational and subject to change; they are not guarantees of future availability or performance.

We implement reasonable safeguards (e.g., HTTPS, WAF, rate-limits), but no system is 100% secure or available.
Outages, throttling, maintenance windows, vendor incidents, and API changes can occur. We may modify, suspend, or discontinue features at any time.
